UP App Privacy Policy 2024

UP School Yazılım Danışmanlık Teknoloji Hizmetleri Anonim Şirketi  ("UP" or "UP School") values the protection and privacy of the information of its users ("Data Subject/Data Subjects") who benefit from our services. This Privacy Policy will inform you about the processing of personal data in our UP application.

Personal data is any information relating to an identified or identifiable person. "Processing" of data means any operation or set of operations which is performed upon personal data, whether or not by automatic means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.  

This Privacy Policy ("Privacy Policy") aims to inform Data Subjects about how UP School uses the information it collects, the responsibilities of the Data Subject, and UP's rules regarding the protection of confidential information.

1. Information We Collect

When you use UP School services, some of your data will be collected for the purpose of being included in UP's main activity of training projects, participating in seminars, webinars, etc., and maintaining and improving employment processes.

Data Subjects' information is transferred to UP School for various reasons such as registering to UP's application via e-mail, participating in projects and trainings conducted by UP School, and interviewing with UP School's business partners for employment purposes. In this case, certain information such as Data Subjects' identity information, contact information, visual and auditory data, and personal data are collected. Except as required by the principles contained in this Privacy Policy and the service policy, the collected information of the Data Subjects is not used by UP School.

As UP School, we process data only to the extent necessary and only for the purpose of providing a functional and user-friendly Application, as well as providing our content and services. We process contact information you provide to us, usage data, or other information necessary for the use of our services. The details are explained to you in the table below and in this Privacy Policy in its entirety:

2. Our Purposes for Using Information

UP School mainly uses the information it collects about Data Subjects for the following purposes:

• To provide services to Data Subjects

• To enable the employment of Data Subjects

• To contact Data Subjects, to finalize their requests and complaints,

• To carry out finance and accounting processes,

• To promote our services; to carry out advertising and campaign processes,

• To improve/develop our products and services according to the feedback of Data Subjects,

• To customize our services according to the preferences, usage habits and interests of Data Subjects,

• To identify and resolve systemic problems in the environments where we provide our services; to carry out information security processes,

• To measure user experiences through identification technologies/cookies, to improve the performance of the environments where we provide our services.  

The purposes stated in this section express the general purposes of use of the information collected about the Data Subjects. Please review the Personal Data Protection Policy for information on the purposes of processing personal data of Data Subjects such as users, applicants, participants of UP School and other matters regarding the processing of personal data.

3. Transfer of Your Information to Third Parties

The information you provide to UP School may be transferred to third parties in order to achieve the purposes stated above. In this context, your information may be shared with our business partners, suppliers, legally authorized public institutions and organizations, and legally authorized private law persons. However, when we are requested to share your information in order to fulfill our legal obligations, your information may also be shared with authorized persons, institutions and organizations.  

The information provided by the Data Subjects will not be transferred to third parties except for the purposes stated in the texts presented to the Data Subjects and the cases required for the provision of the service.  

4. Storage and Protection of Your Information

Your information is stored for as long as the purpose for which we collect it requires. If the legislation stipulates a specific period for us to store your information, this period is complied with. UP School takes the necessary technical and administrative measures to protect the systems, servers and databases where your information is kept against data security threats (cyber attacks, hashes, etc.).  

Data Subjects accept that they are fully responsible for the security, storage and keeping of system access tools (user name, password, etc.) used to benefit from the services offered by UP School, away from the knowledge of third parties.

Our Artificial Intelligence Supported application UP App is powered by OpenAI's ChatGPT. Therefore, if you choose to have a conversation with UP App, your conversations with UP App will be transferred to OpenAI servers via an API connection. We do not have access to your information stored on OpenAI servers as UP School, all your information is kept with crypto protectors. In addition, you allow the data you share with UP App to be used by OpenAI to train or improve their own models. OpenAI will store the information you submit through the API for a maximum of thirty (30) days, after which the information will be deleted, but if OpenAI is required to retain copies under applicable law, OpenAI will keep this information in isolation and will continue processing only in accordance with legal requirements.

UP School may invite you to participate in surveys regarding your use of our services. UP School will rely on your express consent to process the information obtained in this way and will only use it for research and statistical purposes, as well as to improve our services. It will never share this information with third parties, it will only share it if it anonymizes the data.

5. Accuracy and Timeliness of Your Information

Data Subjects are responsible for the accuracy and timeliness of the information they provide. Your information must be transmitted to us in accordance with the truth and must be updated in case of any changes in your information. You can update the information you have shared with UP School at any time by contacting up@upschool.io.

When you provide information to UP School on behalf of someone else, you represent that this information is accurate and that you have the right to share the information with UP School/are authorized to do so.

6. Storage and Deletion of Data

UpSchool, we store your personal data only as long as it is necessary for the relevant processing purpose and limit the storage period to the minimum necessary. You can delete your personal data directly from our mobile application at any time. To do this, you need to click on the "Delete My Account" button.

Please note that if you have an active subscription, you will not be able to delete your account/data as the processing of your data is necessary for the performance of the contract. When the purpose of processing your data ceases or you decide to actively delete your data, UP School will continue to process your data only if it is obliged to do so within the scope of legal retention periods.

7. Redirects to Third Parties

UP School may make redirects to third party links not operated by UP School. During your visit to any of the relevant links, you are subject to the privacy policies and terms of use of the third party you visit. UP School is not responsible for the policies and practices of such third parties.  

8. Changes to the Website and this Policy

UP School reserves the right to change, suspend or discontinue the services, information, visuals and other elements offered without prior notice.

UP School reserves the right to make changes and updates to this Policy. It is the responsibility of the Data Subject to follow the current version of the Policy.

9. Responsibility

UP School is not responsible for any direct or indirect damages and expenses that may arise as a result of any errors, interruptions, delays, viruses, defects and/or system failures that may occur during the electronic presentation of our services.
